Welcome to FORECLOSURE WARRIOR. My law firm has been engaged in the FORECLOSURE BATTLE literally since the beginning of this most recent financial crisis. We started with loan modifications when it was actually “legal” to submit loan modifications for a fee. After SB94 was passed in California (which prohibited collecting advance fees for loan modifications) our firm moved into identifying cases that may be ripe for litigation, and we have moved into the litigation arena, including bankruptcy litigation in regard to foreclosure related cases. In this regard, we have sued many of the major lenders and loan servicers in an attempt to vindicate predatory lending and wrongful foreclosure practices.
One thing we have noticed during the past several years in the foreclosure trenches is that there is a lot of information that comes out on the internet, often from other states like Florida (which is a “judicial foreclosure state” – meaning the banks must foreclose in the courts and not in private trustee sales) that tend to mislead California and Arizona homeowners as to what may or may not be possible when facing foreclosure. Topics such as “produce the note,” and MERS loans have created a great deal of confusion and has fueled speculation among many facing foreclosure.
Given this, we came to the conclusion that there has to be an information website for California and Arizona property owners that seeks to provide critical foreclosure information and insights – what we call “Intel from the trenches.”
FORECLOSURE WARRIOR seeks to fill that gap by providing you with the general information you need to better understand the loss mitigation playing field, and what you may or may not be able to do to maximize your position in this system, which most property owners find very confusing and difficult to navigate.
